Complaints about the arrest and deportation of an Indian man who accused Edison police of brutality have led to a review by an arm of the Department of Homeland Security.

According to a letter from the department's Office for Civil Rights and Civil Liberties, the agency will investigate whether immigration authorities obstructed Rajnikant Parikh's access to the legal system.

Parikh, a liquor store clerk, be came a source of controversy after claiming an Edison police officer used excessive force while arresting him at a 2006 July Fourth event.

Edison officer Michael Dotro charged Parikh with trying to hit him and inciting others to attack him as he tried to disperse a crowd watching an illegal fireworks display at an apartment complex.

A month later, Parikh was arrested by Immigration and Customs Enforcement agents at a rally while he protested Dotro's actions in front of the Edison municipal building. He was deported in April.

At the time of his deportation, Parikh was in ongoing proceedings with Edison over the municipal charges, and he sought the police department's internal investigation reports regarding both arrests.

The civil rights office hears complaints regarding profiling, conditions in detention and the abuse of authority by Department of Homeland Security staff. It has received 300 complaints from August 2003 through September 2006, according to its latest annual report. Of all complaints, 155 remain open, and three-fourths pertain to actions by immigration and border patrol officials.

"It's a positive development," said Ravinder Bhalla, Parikh's attorney in the municipal case. "ICE has a responsibility to investigate whether its employees acted wrongfully."

Edison's internal investigation cleared Dotro and the department of wrongdoing in both arrests of Parikh. But sources familiar with the investigations previously have said Parikh's immigration arrest at the August rally came after Dotro passed information on to his brother, an ICE attorney. Those sources requested anonymity because they are not authorized to discuss the matter.
Edison Policemen's Benevolent Association President Michael Schwarz had no comment on the federal review. "It was a lawful arrest," he said.

Immigration officials defended their arrest and deportation of Pa rikh, stating he was an illegal immigrant.

Parikh entered the country illegally in 1995 and was caught by U.S. border-patrol authorities in Texas. He was using the alias Amit Sheth and was ordered deported the next year, immigration officials said. Under the name Rajnikant Parikh, he obtained a work visa in 1999. Because of his outstanding deportation order, he was arrested in Edison.

But Dave Makkar, a Springfield resident who made the complaint about Parikh's treatment to the federal government in May, said his questions didn't concern the legality of Parikh's deportation.

"All this effort for someone who had nothing in his record other than the deportation warrant," Makkar said, comparing Parikh's case with that of Jose Lachira Carranza, one of the men charged in the Aug. 4 shooting deaths of three college students in a Newark schoolyard.

Carranza made bail and was released from jail in May after being charged with sexually assaulting a child. At the time, it was not known to the court that Carranza, a Peruvian immigrant, was in the country illegally.

"Why all that special effort for (Parikh)?" Makkar said. "Because he's from India?"

Parikh is now in his native village, Bhalla said, and intends to file a federal suit against the Edison police department, its mayor and police chief, Dotro and his brother, and the Department of Homeland Security.

"His rights were violated on several fronts by more than one entity," Bhalla said.

State of New Jersey: Ms. Hester Agudosi Head of Bias Crime Unit in AG’s office for helping and aiding Twp. of Edison and Middlesex County Prosecutor to cover up the July 4, 2006 incident of Police Brutality under racial bias by Patrolman Dotro against Mr. Parikh and then falsely implicating him under fabricated criminal charges. Superior Court Judge: Robert Longhi knowingly conspired with Police Union President Michael Schwartz to deny justice to Mr. Parikh. He broke all Court notification rules and ignored all State and Federal precedents in such criminal trials. He openly lied in the Court also and he knew it he is retiring next month. Although Mr. Parikh has already been deported to India on April 12, 2007 but the residents of New Jersey and Mr. Parikh’s US born wife deserve to know who is accountable for the violation to US Constitution, The Bill of Rights and The Pledge of Allegiance, misuse of State and Federal resources including over $100,000.00 spent just to deport 1 individual in gross violation to his basic human rights.

All those involved in this heinous crime of violating US Laws did it with full understanding and knowledge of law. These are the individuals who are sworn to uphold US Constitution, The Bill of Rights and The Pledge of Allegiance and they have knowingly violated it. Some one from the Federal Government has to stand up in front of them and show them there is accountability for their actions.

Inadvertently a Complaint was filed on 3-28-07 in the above matters with USCIS Ombudsman Mr. Prakash Khatri who also failed in his constitutional duties to forward the same in timely manner to the office of Civil Rights and Civil Liberties. Mr. Khatri has been requested to forward the Complaint along with all attachments to your office.

We hope justice will be done, accountability will be established and those found guilty will be punished to the maximum extent of the law.

The deportation arrest of an Indian man during a rally protesting alleged police brutality in Edison came after information was passed between the accused officer and his brother, an attorney with the federal Immigration and Customs Enforcement agency, people familiar with the case said.

The public arrest of Rajnikant Parikh as he marched in front of Edison town hall Aug. 2 inflamed tensions between the township's burgeoning Asian-Indian community and the police department, and led to a four-month internal investigation reviewed by the state attorney general and the Middlesex County Prosecutor's Office. Until the arrest, not even Parikh's supporters knew he had a fugitive warrant based on a 10-year-old outstanding deportation order. Police Chief George Mieczkowski and Edison Mayor Jun Choi said they were unaware of the plan to arrest him at the rally.

Last month, the mayor and police chief released a joint statement calling the arrest an "unfortunate incident," and blamed improper communication between an Edison officer and an ICE official. They declined to name either.

But three people with knowledge of the internal investigation said the connection between the agencies was the Edison officer whom Parikh accused of brutality, Michael Dotro, and his brother, ICE attorney Sam Dotro. The sources spoke on the condition they not be identified because they were ordered not to discuss the case.

Choi and Mieczkowski said the internal investigation determined that two Edison officers knew of the plan to arrest Parikh at the rally, but they had acted without informing their superiors.
"While the arrest of Parikh served a legitimate law enforcement purpose, the timing and the environment of the arrest was inappropriate," according to a joint statement released last month by Choi and Mieczkowski.

Parikh was arrested at the Aug. 2 rally specifically to discredit him and his complaints against Michael Dotro, the sources said. Before federal agents arrested him, Parikh and his supporters spent nearly a month calling for Michael Dotro's suspension.

Michael Dotro arrested Parikh, a 30-year-old liquor store clerk, July 4 on charges that Parikh hit the officer and incited others to join in the attack as Dotro tried to disperse hundreds watching an illegal fireworks display at a township apartment complex.

The next day, Parikh accused Dotro of roughing him up during the arrest, and circulated a picture of Parikh's bruised face. Parikh also accused Dotro of racism. Two Indians brought similar complaints against Dotro a year earlier, but an internal affairs review of that incident cleared the officer.

Responding to Parikh's complaints, Edison police launched an internal affairs review.
Just as Parikh went public with his complaints against Dotro, the officer contacted his brother at the federal Immigration and Customs Enforcement agency, sources said. The conversation ultimately led to an investigation by ICE and the Aug. 2 arrest, the sources said.

That afternoon, more than 100 people had gathered outside Edison town hall, the crowd split between Parikh supporters and police supporters. Minutes after he arrived, Parikh was confronted by two plainclothes ICE agents.

He was arrested on a decade-old deportation order on charges that he skipped a Texas immigration hearing. Parikh was taken inside police headquarters and held for two hours before agents drove him to the Middlesex County jail in North Brunswick.

Parikh's supporters immediately claimed the police colluded with ICE to silence Parikh. Choi and Mieczkowski denied knowledge of the planned arrest and any police involvement. The day after the arrest, an internal investigation cleared Michael Dotro of wrongdoing in the July 4 arrest.
ICE officials said the Aug. 2 arrest was prompted by a call from the Edison Police Department and resulted from "extensive cooperation" from the local department. The police chief denied any knowledge of those communications at the time.

In their statement last month, the police chief and mayor said the results of the Edison police investigation confirmed that an officer had contacted ICE about Parikh, but that the officer did not inform his superiors. At least one other department officer, they said, knew of the plan to arrest Parikh. Mieczkowski and Choi declined to name the officers. Mieczkowski said the department has since created a new policy for how officers handle requests for assistance from outside law enforcement agencies. The two officers involved were ordered to receive counseling, Mieczkowski said.

Michael Dotro, a patrolman with three years on the force who earns $60,000 a year, did not respond to multiple attempts to reach him for comment. Sam Dotro, who earns more than $87,000 a year as an ICE attorney, also declined to discuss the case through a woman who answered the door at his home.

Scott Weber, field director of the ICE Office of Detention and Removal in Newark, declined to comment about Sam Dotro's involvement or if the agency knew about Parikh's claims against Michael Dotro before making the arrest. "Information was received from the Edison Police Department regarding an alien who was wanted on an ICE fugitive warrant," ICE spokesman Michael Gilhooly said in a statement in response to questions about the timing of the arrest and Sam Dotro's role. "(We) acted on that information and arrested Rajnikant Parikh."

Parikh remains at the Hudson County jail in Kearny. In an interview last week, he said Michael Dotro's name came up a couple of times as he was being processed after his arrest at the rally, though he didn't see the officer that day.

Parikh's attorney, Ravi Bhalla, said the Dotro brothers' involvement in ICE's arrest of Parikh raised serious questions. "I find it very disturbing, to put it mildly," Bhalla said. "It certainly calls into question (Michael Dotro's) credibility as an officer."

The original charges against Parikh from the July arrest are pending. He also is fighting his deportation based on arguments that he applied for permanent residency in 2005 after he married Julie Patel, an Edison medical student who is an American citizen. "They could've arrested me when I applied for a green card." said Parikh. "They wanted me, they could've arrested me anyways, anywhere."

BILL OF RIGHTS APPLIES TO EVERYONE, EVEN ILLEGAL IMMIGRANTS

The Bill of Rights applies to everyone, even illegal immigrants. So an immigrant, legal or illegal, prosecuted under the criminal code has the right to due process, a speedy and public trial, and other rights protected by the Fifth and Sixth Amendments. This fact sheet from the National Lawyers Guild outlines a host of rights afforded to immigrants and citizens alike. (There are a few rights reserved for citizens. Among them are the right to vote, the right to hold most federal jobs, and the right to run for political office.)

But immigration proceedings are matters of administrative law, not criminal law. (As a result, the consequence of violating your immigration status is not jail but deportation.) And Congress has nearly full authority to regulate immigration without interference from the courts. Because immigration is considered a matter of national security and foreign policy, the Supreme Court has long held that immigration law is largely immune from judicial review. Congress can make rules for immigrants that would be unacceptable if applied to citizens.

In 1952's Harisiades v. Shaughnessy, the Supreme Court upheld the right of Congress to expel noncitizens who were former Communists. "In recognizing this power and this responsibility of Congress, one does not in the remotest degree align oneself with fears unworthy of the American spirit or with hostility to the bracing air of the free spirit," Justice Felix Frankfurter wrote in his concurrence. "One merely recognizes that the place to resist unwise or cruel legislation touching aliens is the Congress, not this Court."

Still, immigrants facing deportation do have some rights. Most are entitled to a hearing before an immigration judge, representation by a lawyer (but not one that's paid for by the government), and interpretation for non-English-speakers. The government must provide "clear and convincing" evidence to deport someone (a lower standard than "beyond a reasonable doubt").

On the other hand, some immigrants who are suspected terrorists may not be allowed to confront the evidence against them. In 1996, Congress established the Alien Terrorist Removal Court, a secret tribunal that can examine classified evidence. (Interestingly, Congress mandated in the same law that an immigrant tried by the terrorist court would have the right to counsel at government expense.) But the Alien Terrorist Removal Court has never been used, and a Department of Justice spokesman said he isn't aware of any plans to use the terrorist court any time soon.

South Amboy: Edison has to submit the complete files of its investigations of the July 4 and Aug. 2 incidents that led to the arrest of Rajnikant Parikh to his attorney under terms of a ruling Tuesday by South Amboy Municipal Court Joseph C. Hoffman.

Hoffman ordered that the files be turned over during a hearing on the disorderly persons charges against Parikh, charges that stem from the July 4 illegal fireworks display at Dayton Drive apartments. Hoffman ruled that Edison must give the available files to Ravinder Bhalla, attorney of Parikh, but denied Bhalla’s motion to gain access to the personal file of the patrolman Michael Dotro, the police officer involved in the arrest and subsequent charges of assault and police brutality. Hoffman also denied Bhalla access to the internal-investigation records of a 2005 charge against Dotro involving allegations of police brutality by two Indian business owners, Vimal Joshi and Atul Patel, in which Dotro was cleared last year.

Bhalla said he may request the records again later in the trial. Parikh is being held at the Middlesex County Adult Correction Center in North Brunswick, pending a deportation order that he is appealing. He was present during the hearing on the Edison charges Tuesday.

Dotro arrested Parikh, 30, during an unscheduled July 4 celebration on charges of aggravated assault on a police officer, resisting arrest, rioting and failure to disperse. The charges were later downgraded to disorderly charges by the Middlesex County Prosecutor’s office. The case is being heard in South Amboy.

Parikh filed a complaint against Dotro and other township police officers, saying he was beaten up without provocation.

Dotro reported slight swelling in his face and minor cuts on his arms after he subdued and handcuffed Parikh, who elbowed and punched the officer in the face, Dotro said. Dotro has given Bhalla a video showing his injuries.

“I am happy the judge granted access to the internal-investigation file,” said Bhalla. Hoffman made the ruling after 30-minute private conference outside the courtroom.

Bhalla asked Hoffman to dismiss the entire case based on published reports that Dotro’s brother, Sam Dotro, is an attorney for Immigration and Customs Enforcement, and was involved in having Parikh arrested by ICE on Aug. 2 on an immigration charge. Hoffman denied that motion saying, “It’s premature and discovery is incomplete.” Hoffman gave the township 20 days time to produce the documents and said he would set a hearing date sometime after that.

“I will need sometime to go through the records,” Bhalla said. “It’s a political prosecution. My client is innocent.”

EDISON — The Police Benevolent Association will ask a higher court to stop the release of police internal investigation files to the defense attorney for Rajnikant Parikh after being denied a similar request in municipal court in South Amboy last week.

"We disagree with the judge's statement," PBA President Michael Schwarz said about the decision by South Amboy Judge Joseph C. Hoffman ordering the release of the files. Schwarz said the internal investigation files should not be released because they are confidential.

On Feb 13 Hoffman asked Edison to submit the complete file of its investigations of the July 4 and Aug. 2 incidents that led to the arrest of Parikh on various charges, including resisting arrest and rioting. Hoffman ordered the files be given to Parikh's attorney under the terms of the ruling.

Last week, the PBA asked Hoffman to reconsider his decision.

"PBA wants me to reconsider my decision for production of the discovery (of the files)," Hoffman said. Hoffman said he denied the motion to reconsider the decision because the PBA has no standing in the case.

The PBA, which had not been formally involved in Parikh's case, is now intervening, according to a letter Hoffman said he has received from the PBA.

The PBA now plans to appeal Hoffman's decision to Superior Court.

Parikh is being held at the Middlesex County Adult Correction Center in North Brunswick, pending a deportation order. EDISON — The Rajnikant Parikh case appears to be headed back to Superior Court.
The Edison PBA has filed an appeal to block a ruling by South Amboy Municipal Court Judge Joseph C. Hoffman that would turn over internal-investigation files to Parikh's attorneys. Parikh's attorney, Paul Brickfield, plans to oppose the motion.

At issue are the files that came out of Edison's probe into the arrest of Parikh following an illegal fireworks demonstration last July 4. Parikh and police traded charges of assault. The case was heard as a disorderly persons offense last month in South Amboy.

After Hoffman ruled that Parikh's attorneys had a right to see the internal investigation documents, the Edison PBA appealed to Hoffman to change the ruling. Hoffman said he dismissed that appeal made by the PBA attorney Thomas C. Sciarrabone because the PBA has no standing in the case.

The PBA then filed the appeal in Superior Court.

Brickfield said he will file papers opposing the appeal by Wednesday. Brickfield said a Superior Court hearing is not yet scheduled, but most probably will be held the week of March 12.
"Superior Court Judge Robert Longhi wants to see the transcript made by South Amboy Judge," Brickfield said. After that, Longhi will schedule a hearing.

Parikh is being held at the Middlesex County Adult Correction Center in North Brunswick, pending a deportation order. He was arrested by Ptl. Michael Dotro during the July 4 fireworks on charges of aggravated assault on a police officer, resisting arrest, rioting and failure to disperse. The charges were later downgraded to disorderly charges by the Middlesex County Prosecutor's Office.

Hoffman told Edison to submit the two internal investigation files to the Parikh's attorneys by Tuesday. Brickfield said he expects to receive the file next week. "But will hold the investigation files and won't disclose it until Judge Longhi decides on the motion," he said.

"We disagree with the judge's statement," PBA President Michael Schwarz said about the decision by Hoffman ordering the release of the files. Schwarz said the internal investigation files should not be released because they are confidential.

However, Township Mayor Jun H. Choi said he will abide by Judge Hoffman's ruling. "We will submit the files on time," Choi said last Tuesday.

MIDDLESEX COUNTY — Superior Court Judge Robert Longhi has left it to South Amboy's municipal court judge to decide whether Edison's Policeman's Benevolent Association local can intervene in the Rajnikant Parikh case.

Parikh is facing disorderly person’s charges stemming from a July 4 illegal fireworks display in Edison. The PBA wants to block the release of the police department's internal investigation records to Parikh's defense attorneys for use during a trial in municipal court.

Longhi, sitting in New Brunswick, left the decision to South Amboy Municipal Court Judge Joseph C. Hoffman on whether he wants to reconsider his earlier ruling that barred the union from intervening as a third party in the case. Hoffman earlier ruled that PBA has no standing in the case.

During the hearing on Monday, Longhi also ruled that the files will not be turned over until Hoffman makes his decision. The files had been scheduled to be turned over today under Hoffman's prior ruling.

The PBA last week appealed to the Superior Court to block the release of the files. PBA attorney Thomas Sciarrabone said, "I am satisfied and we are going back to the municipal court." Sciarrabone said that Longhi gave the PBA 10 days to submit its application for reconsideration to Hoffman. "I am hopeful the decision will go in PBA's favor," he said. However, Sciarrabone added that, if Hoffman denies the motion again, the PBA may again appeal the decision.

The PBA wants to block the release of the files because the files contain confidential reports, PBA President Michael Schwarz has said.

Parikh's attorneys Paul Brickfield and Ravinder Bhalla, who attended the Superior Court hearing, said they expect to get the records. Brickfield noted that it's been seven months since his client was jailed and now the case will he delayed further because of the PBA's appeal of Hoffman's initial ruling. "Full disclosure of the files is best for the community," Brickfield said.

On Feb 13, 2007 after deliberate, intentional & inordinate delays Municipal Judge Hoffman Ruled that both Internal Investigation reports concerning Parikh’s arrest on July 4th by Dotro and Aug. 2, 2006 by ICE be released to him with in 20 days. In an unprecedented move before the deadline of March 6, 2007, the Police Union PBA, which is not a government entity, but rather a private lobbying and collective agency for the private interest of individual police officers, a group neither vested with nor entrusted with the public interest, filed a motion seeking to intervene and making demands not to release the Internal Investigation Reports of victims arrest on July 4th & his subsequent arrest on Aug. 2, 2006 by Immigration and Custom Enforcement ICE from the venue Municipal Compounds of Edison where Parikh along with few supporters protesting against the Police Brutality under Racial Bias done to him on July 4th by Patrolman Michael Dotro. Judge Hoffman denied them by saying they have no standing. It must be noted PBA has a membership of 190,000 in voters term it is over 300,000 voters and in the last election PBA gave more than $1 million to Democrat Candidates Election Campaigns, which is not possible any where else in the world.

Retiring Superior Court Democrat Judge Robert Longhi after breaking all rules of notification calling the victims Counsels around 9.00 A.M. to be present in his Court at 10.30 AM the same day, entertained PBA’s contention despite Assistant Prosecutor Abromowitz objections that PBA has no standing whatsoever in this matters and their contentions of unrest in the community on account of release of IA files are unfounded and baseless. He was appearing on behalf of the State to prosecute Parikh on false & fabricated criminal charges framed by Patrolman Dotro on July 4, 2006. Judge Longhi misrepresented in Court there are 2 cases where intervention was granted and stayed the delivery of the IA files to the victim and asked Judge Hoffman to put his reasons for denial to PBA to intervene in writing.

Parikh’s attorney Paul wrote in his brief to oppose PBA, “The right of a party to intervene in a criminal case is extremely rare and extremely circumscribed. Indeed, there is only one reported case in New Jersey that found such right. NJ Super 244 (Appell. Division 1995) a case involving a confidential informant in a homicide case.

On the questions raised by PBA of confidentiality of Internal Investigations and claims of concern about unrest of a community. Paul has written, “The very section of Attorney General’s guidelines on Internal Affairs investigations cited by PBA provides that any confidentiality of records shall be overridden by a “Court Order.” In addition, the Municipal Prosecutor has not filed an Appeal to Judge Hoffman’s original orders of Feb 12, 2007 to release Internal Investigation reports to the victim Parikh. Nor has any other official law enforcement authority such as the Edison Police Department or the State of New Jersey sought to join in the PBA’s motion or sought to persuade the Municipal prosecutor to file an appeal. In addition, Middlesex County Prosecutor’s office through its Asst Prosecutor Abromowitz has already stated before Judge Longhi that the PBA has no standing whatsoever in this matter. Accordingly, since there is no allegation or proof of confidentiality or privileged information by a third party directly affected, as required by the relevant case law, the PBA’s motion to intervene should be denied.

The right of a defendant to obtain Internal Affair investigation reports and other similar evidence is well established under both United States and New Jersey Law. State v. Harris, 316 N.J. Super 384 (App. Div. 1998) The right of confrontation requires disclosure of (police personnel records) where a defendant advances some factual predicate making it reasonably likely that information in the file could affect the officer’s credibility. Id 387. The Court noted that “[t]he Sixth Amendment of the United States Constitution and Article 1, section 10 of the New Jersey Constitution guarantees the right of an accused in a criminal prosecution to be confronted with the witnesses against him” (citation omitted) and that “[t]he essential purpose of confrontation is to secure for the defendant the opportunity of cross examination. Cross examination is the principal means by which a witness’ credibility is tested.”

Thus, under New Jersey Law, so long as defendant shows “some factual predicate” that would make it reasonably likely that information in the desired file is relevant or could affect a witness’s credibility, disclosure shall be made. The review and release of such records is now fairly common. State v. Ewtushek, App. Div. 2005 WL 1802099 (7-1-05)

Likewise, the same principle has been established in Federal Law since at least UNITED STATES V. RICHARD NIXON, 418 U.S. 683 (1974) where a ‘generalized interest in confidentiality” by even the President of the United States was insufficient to prevail over the “fundamental demands of due process of law in the fair administration of criminal justice. The generalized assertion of privilege must yield to the demonstrated, specific need for evidence in a pending criminal trial.” Id at 713.

In the case of July 4, 2006 arrest of Raj Parikh, the records relating to the Internal Investigation which allegedly cleared officer Dotro involved taking of statements from witnesses as well as a statement from patrolman Dotro himself. As per PBA’s providing

News report that 12 Edison Police officers responded to the scene. In contrast, the limited discovery provided to date (March 28, 2007) to the defendant by the prosecutor includes a report of Dotro but does not contain any reports from these officers. Presumably, each of these officers as well as other witnesses and on, on information and belief, the defendant himself provided statements to the Internal Investigation. Such statements are clearly discoverable to the defendant for use in cross examination.

Likewise the records of the second Internal Affair investigation relating to the arrest of Rajnikant Parikh on Aug. 2, 2006 are discoverable. Based on Star Ledger of 12-11-06 news report, it appears that Patrolman Michael Dotro had a brother working for Immigration and Custom Enforcement ICE and that the arrest of Mr. Parikh was planned between Patrolman Michael Dotro, his brother Sam Dotro and possibly other officials. Such actions raise classic credibility issues, such as racial bias and other improper motives, for cross examination of Patrolman Dotro. The involvement of Patrolman Dotro in the ICE arrest of the defendant may be an attempt to deny him the right to a Public Trial, the right to Clear His Name, and the right to pursue allegations of Police Misconduct and Brutality under Racial Bias. These areas clearly go to the credibility of Patrolman Dotro’s description of the events of July 4, 2006, which Patrolman Dotro has claimed was self defense.

In addition, Patrolman Dotro’s credibility has been placed at issue by the decision of the Middlesex County Prosecutor’s office to downgrade the Indictable Charges in this case. Patrolman Dotro signed complaints alleging the Indictable Offense of Aggravated Assault on a Police Officer. However, the Middlesex County Prosecutor’s Office, upon reviewing same, has chosen to downgrade or reduce this charge, there by explicitly rejecting some of the claims of Patrolman Dotro.

The PBA’s rationale to withhold discovery, namely possible reprisals by the Asian-Indian community against those members of Edison Police Department involved in the arrest of Mr. Parikh, does not rise to the good cause necessary to justify non-disclosure of the internal affairs reports. Under R. 3-313 (f) (1) and R. 7:7 (e) (1), a court, on a motion and for good cause, may consider an application for a protective order to withhold evidence from discovery under only certain circumstances.

In the instant case, the factual basis underlying the production of the Internal Affairs reports does not present sufficient confidentiality concerns to justify withholding them from discovery. The Edison Police Department investigation concluded that there was no impropriety on the part of the arresting officers. If the police officers involved in Mr. Parikh’s arrest committed no wrongdoing, the PBA has nothing to fear by releasing the contents of the report. Where a law enforcement investigation has been completed, the State’s interest in confidentiality of Internal records related to the investigation is substantially reduced. Shuttleworth V. Camden, 258 N.J. Super. 573, 585 (App. Div. 1992), certif. den., 133 N.J. 429 (1993). In the instant case, the police have completed their investigation. Any police need for confidentiality pales in comparison for Mr. Parikh’s discovery needs to present an effective defense.

PBA’s application is a generalized concern for speculative unrest that may occur in the community. Fact is PBA’s application is not supported by a single law enforcement agency such as the Prosecutor of Middlesex County, the Municipal Prosecutor handling the case, the Town of Edison, or the Edison Chief of Police. In short, the individuals and entities actually entrusted with public safety have not joined in this motion. Nevertheless the PBA with this motion seeks to place on itself the mantle of determining what is good for the community of Edison and what should or should not be seen by its citizens, taxpayers and employers. Moreover, it is the alleged actions of the officers themselves, Patrolman Dotro on July 4, 2006 in arresting defendant as well as the actions of Patrolman Dotro and possibly others in arranging the re-arrest on Immigration Charges of the defendant before a large crowd on Aug. 2, 2006 that caused the unrest. Like wise based on news paper reports it was member/supporters/member families of the PBA that have resorted to name calling in Edison by taunting Indian protesters as “Cockroaches, Animals, Illiterates, Illegal Go Home.” Also used racially derogatory statements, profanity and racial slurs. Yet throughout it all there has been no violence there by undermining the PBA’s very stated reason to block Internal Affair Reports. It is also interesting to note that although the PBA claims to be concerned about unrest in the community and danger to its officer, it is the PBA itself that conducted several of the rallies at issue in this case. Indeed, the PBA called the latest rally on Aug. 14, 2006 seeking the resignation of the Edison Mayor Choi. Counsel Brickfield wrote “For the aforementioned reasons, the Court should deny both PBA’s motion to intervene and the motion to block access to the defendant Parikh of internal investigation reports.

EDISON — Rajnikant Parikh, the Edison resident who was at the center of charges and counter-charges of racism, brutality and civil-rights violations growing out of an impromptu fireworks display July 4, was deported to India Thursday evening.

Adam Puharic, a U.S. Immigration and Customs Enforcement spokesman in Newark, said Friday that Parikh had been deported to his native country. The order of deportation carried out on Thursday was initially issued in June 1996 after Parikh was apprehended, using the name Amit Sheth, by the U.S. Border Patrol in Texas in 1995. That 11-year-old order by an immigration judge was reinstated for the Edison man in the name of Rajnikant Parikh, according to a press release issued by ICE Friday. According to the ICE statement, Parikh re-entered the country in 1999 under a work visa and "used two different identities over a 12-year period in order to circumvent immigration law."

Parikh, who was in the Middlesex County Adult Correction Center for eight months, was arrested by ICE detention and removal officers on Aug. 2 at a rally at the Edison Municipal Complex. The rally was held to show support for Parikh's claim that he was brutalized by police during his arrest at a July 4 celebration at Hilltop Apartments off Oak Tree Road in Edison. Edison patrolman Michael Dotro was the arresting officer.

Parikh's wife, Julie Patel, who is studying medicine in Poland, said she is waiting for Parikh's phone call. Patel, who was planning to come to the United States in May, said, "I don't know what to do now," during a telephone interview Friday. "The township and police conspired in getting him arrested," she said.

Parikh's attorney, Ravinder Bhalla, said he is considering filing a civil lawsuit against Edison Township, Michael Dotro and his brother, Sam, who is an attorney employed by ICE, and others. Bhalla said a notice of claim, which must be sent to a municipality months before an individual files a lawsuit against the town, was filed on Aug. 13.

Paul Brickfield, an attorney representing Parikh in the criminal case, was disappointed Friday with his client's deportation. "It's very unfortunate that it denies to Parikh the opportunity to clear his name in open court, and it also denies the residents of Edison an opportunity to hear in open court what actually happened on July 4." Brickfield said he expects the township prosecutor to now move to dismiss that case.

The case is being heard in South Amboy Municipal Court before Judge Joseph Hoffman. A hearing is slated for Wednesday before Hoffman to determine if the Edison Policeman's Benevolent Association can intervene in Parikh's case.

EDISON — South Amboy Municipal Court Judge Joseph C. Hoffman Wednesday put an end to the eight-month-long criminal proceedings against Edison resident Rajnikant Parikh who was deported to India, his native country, last Thursday.

"The case is dismissed," Hoffman told a reporter.

Parikh was facing disorderly person’s charges stemming from a July 4 illegal fireworks display in Edison. He was held at the Middlesex County Adult Correction Center in North Brunswick after being arrested on Aug. 2 by the Immigration and Custom Enforcement officers. The arrest occurred during a rally at the Municipal Building to protest alleged police brutality by patrolman Michael Dotro during Parikh's July 4 arrest.

Dotro charged Parikh with aggravated assault on a police officer, resisting arrest, rioting and failure to disperse during the July 4 incident. The charges were later downgraded to disorderly person offenses by the Middlesex County Prosecutor's Office.

Edison Township Prosecutor Thomas Downs said Wednesday that the Immigration and Customs Enforcement bureau informed him on April 12 that Parikh was to be deported that evening. Downs said the township made no request to hold Parikh in this country while the criminal case was pending. "I have no jurisdiction in the Federal Government," Downs said. The case could not proceed without Parikh so Downs requested dismissal of the charges.

Ravinder Bhalla, Parikh's criminal attorney, said, if Edison had requested that ICE postpone Parikh's deportation because of the criminal charges, "ICE would have obliged."

ICE spokesman Adam Puharic said ICE had been in constant touch with Edison Township since Parikh was taken into ICE custody. "ICE was in communication with Edison Twp. to notify them of our intention to remove Parikh," Puharic said.

Bhalla contended, however, that "Edison avoided considerable embarrassment that would have resulted if the internal investigation files were released and we had a public trial in this matter." He said Parikh's deportation was a convenient way to eliminate the trial.

Rajnikant Parikh was arrested on Aug. 2, 2006 while demonstrating against Police Brutality with few children, adults and elderly members of his community on an 11 yr old deportation orders issued by a Texas Judge in his absentia in a conspiracy between local Police & ICE to hush up Police brutality under racial bias done to Parikh by Patrolman Dotro on July 4, 2006. This was done against the Town law, “that local police can not call Immigration & Custom Enforcement on its residents with a motive and especially without discussing with their Superiors.

Also on Aug. 2, 2006 entire community of Indian origin was called cockroaches, animals, illiterates and illegal go home by a white knuckle head group belonging to Police Union PBA members/their family members & supporters. These are the worst ever called Racial Slurs against this community in the history of America that too in the presence of Print & TV Media. They were also displaying posters, “If you act like animals, you will be treated like an animal.” People wearing T-Shirts, “welcome to America, speak in English now.” They were also shouting all kinds of racist remarks towards senior citizens, housewives, children and few adults from the Indian American community who were chanting, “We want justice, we are all children of the same God.”

Rajnikant Parikh is the victim of Police Brutality under racial bias by Patrolman Michael Dotro, Selective enforcement of Law under racial bias by ICE officers Sam Dotro & Peralta. Apartheid was abolished in this country in late 60’s it looks like everything is still on paper only the proof is after 40 years we both are sitting in this Hall on Hunger Strike to protest against Legalized Racism in the state.

Number of intellectuals, philanthropists, defenders of freedom and civil right activists with greater eloquence and more original minds than we posses has spoken on these issues of Racial Equality and Equal Justice for All. Unfortunately NJ is the worst example of racial segregation, moral and ethical corruption. Yet no one mention the word Race in this state. It is not the question of Mayor Jun Choi of Edison or Clara Harelik of Springfield presiding over racist administrations. It is also not the question of Police Officer Michael Dotro of Edison practicing brutality on unarmed colored residents Raj Parikh, Bimal Joshi & Atul Patel or Officer Kahora pulling a gun on a 5 yr old & a 9 yr old colored children. It is not the question of one Rajnikant brutally beaten by the police in Edison. It is the question of complete failure of our Secular System and we must try to make it secular. In order for us to do that first of all we must believe in Rev. M.L.K’s divine vision “First and foremost we are American Citizens. We are not here to advocating violence. The only weapon we have is the weapon of protest. The great glory of American Democracy is the right to protest for your rights.”

That’s exactly what we are doing here to day by going on hunger strike, protesting against the gross injustice, racial discrimination and human rights violation done to so many Rajnikants by the NJ police in different parts of NJ. There are so many Rajnikants who have suffered in other parts of NJ. As Rev. M. L. King said “Injustice any where is a threat to justice every where.” The incident of police brutality and local government & police sponsored Racial Slurs against a minority community in Edison on July 4, 2006 and Aug. 2, 2006 is a threat to all minorities living in other parts of NJ. This protest symbolizes the protest and silent sufferings of so many other Rajnikant’s in different parts of NJ. We demand Suspension of Officer Michael Dotro along with other officers involved in selective enforcement of immigration laws and prosecution of individuals involved in inhuman Racial Slurs against the entire community of Indian origin to send a clear message to all those who are occupying the seats of power in New Jersey that they must believe in Equal Justice & Secular values of America. America is a melting pot of best of all brains & cultures from around the world that have made this country Great. “Internal Affair those who don’t know for them it may be a very hi-tech and very responsible department. But the fact is Internal Affair is a department with in the same Police Department of every town. A broken Table with a broken chair is lying in a corner of that department. When a member of the public walks in to file a complaint against the officer of that department any officer who is on duty at that time can take that complaint. Don’t get surprised if the officer who is accepting your complaint is the same against whom you have written the complaint.

Coming to PBA it is highly unethical to have a Police Union, no where in the world Police Unions are allowed. When we have allowed a police union, let’s have a union for FBI, CIA as well as Politicians. By the way in NJ we do have a union of Politicians in NJ. There are 80% Democrats and 20% Republicans. The Republicans are living off the crumbs thrown by Democrats. That is the reason NJ is most corrupt state in the world.

This PBA has a membership of 190,000 in voter terms we are talking 325,000 voters or more. In the last elections PBA gave $1.4 Million to Democrats and they have most expansive lobbyist sitting in the Trenton to safe guard their interests.

Looking at this sceneroy you think an officer who had a cup of coffee with his colleague in the morning and in the afternoon shared Tiffin and probably going to wine and dine together at night has any interest to nail his colleague? What interest the politicians have to nail Police Departments when they treat them as big money and big chunk of voters? We leave to the members to judge and use their conscience for the answers.

You must understand that the Citizens For Democracy is fighting against organized and legalized Racism in the State of New Jersey. Its volunteers will not hesitate from exposing individuals like you who may be from Indian origin with close ties to Democrats of NJ, indulging in racial bias towards other caste from Indian origin especially at Places of Worship. You along with your other friends have tarnished the sanctity and dignity of Dashmesh Durbar Sahib Ji on number of occasions by violating free speech rights of the individuals whom you and your friends think do not belong to Sikh community. It is very sad all of you have forgotten the definition of a “Sikh” and have become a disgrace to the community of warriors. Sikh history has a century old tradition which tells the whole world that they always fought against injustice & racism.

As you are already aware from our Press Release of Sep. 14, 2006 our volunteers are going for a Hunger Strike on Sep. 26, 2006 to demand written apology on moral grounds from the Edison Mayor, Police Dept. and PBA for sponsoring the worst ever called Racial Slurs in the history of America against the Indian-Americans on Aug. 2, 06.

Please be advised these volunteers will sit out side the Municipal Building of Edison by the Parking lot on Sep. 26, 2006 from 9.00 A.M. to 6.00 P.M. They will not eat or drink any thing after 12.00 A.M. (midnight) Sep. 25, 2006. After 6.00 P.M. they will join the SAALT Seminar on “Rights of Immigrants” at Iselin Public Library from 6.30-8.30P.M.

From the library these volunteers will walk on Oak Tree Road business district from Pathmark Plaza to Sona Jewellers. From there they will sit in India House till 12.00 Midnight and break their hunger strike with a Glass of Juice to be offered by Mr. Pradip “Peter” Kothari of India House.

Please be advised there will be strictly no slogan shouting at any times by these volunteers or the sympathizers/supporters who may visit them in the Municipal Complex or walk with them on Oak Tree Rd. business district or sit with them in the India House. If any permit is required or fee is to be paid to any Township or County or State authorities for this Hunger Strike/Protest, please let us know so accordingly we can comply all the applicable town, county and state laws and regulations.

As far as precedent for Hunger Strike to demand justice by Private Citizens in New Jersey is concerned the undersigned twice sat on a day’s Hunger Strike on July 4, 2005 and Aug. 8, 2005 along with his family and friends in the township of Springfield. Then Governor Richard Codey, Supreme Court Chief Justice Deborah Poritz, Attorney General Peter Harvey, Congressman Mike Ferguson, Senator Tom Kean, Assemblymen Jon Bramnik, Eric Munoz, US Senator Jon Corzine (now Governor of NJ), Police Superintendent Colonel Joseph Fuentes, Union County & Springfield elected politicians and administration never objected to that. That is a different issue the Racist & Corrupt Judge Firsichbaum, Mayor Clara Harelik, Police Chief William Chisholm and officer Kahora (who at gun point stopped a 5yr old and 9 yr old) of Springfield are still on the same posts. Unfortunately the victims of Bias Crimes, threatening phone calls, letters, e-mails, property vandalized, free speech rights violated never got any justice till date.

Please be advised for the safety and security of our volunteers we are not disclosing the names of our volunteers who will be sitting for Hunger Strike on Sep. 26, 2006. Our horrified experience during the Press Conference of Mayor Choi on Aug. 13, 06 is stopping us from disclosing the names of our volunteers. In that conference right in front of the Mayor and Edison Police self-proclaimed Exe. V.P. of IBA Mr. Chandrakant Patel charged towards our Spokesperson Mr. Dave Makkar with the intentions of physically assaulting him for making remarks that all the IBA functionaries which is a non-profit organization including Satish Poondi may have indulged into money laundering by giving $20,000.00 to Bollywood Star Bipasa Basu without a written contract. Further he added that IBA body is illegal and unelected. An alert officer of Edison Police stopped Mr. Patel when he was dangerously close to Mr. Makkar. Then outside the building another functionary Jayesh Amin speaking heatedly raising objections why IBA was discussed inside physically came too close to Mr. Makkar and was whisked away by Mr. Dilip Patel & Jasal Amin (Advisory Chairman & V.P. IBA)

We sincerely wish the things should not have come to this stage if on Aug. 23, 06 Mayor Jun Choi and Police Chief George Mieczkowski would have agreed to written apology respecting the sentiments & dignity of majority Indian-Americans on moral grounds for the worst ever racial slurs of Aug. 2, 2006 against Indian-Americans in the history of America. Mayor joining unethical & discredited individuals is no solution. We just wanted to remind them the famous words of our second President Hon. John Adams:

Thank you for your misguided efforts of down grading the charges against the victim of Police Brutality and gross injustice within the parameters of our rotten system. Here unionized Police force runs the administrations, has powers to finance politicians elections and politicians can use PBA credit cards for their personal needs. We are little puzzled on the date of this letter being Aug. 17, 2006 and why in our two meetings of Aug. 23rd and 29th no mention was made to this particular letter? That raises the issues of credibility for the office you are holding and your intentions to dispense equal justice. Even the Assemblyman Barnes and Senator Buono who were gracious enough to mediate may not approve this secrecy on your part. If you remember we complimented you as the only face from administration with intentions to settle the contagious issues of Police Brutality of July 4, 2006, civil rights violation of the victim on Aug. 2, 2006 and worst ever most inhuman, uncivilized, abusive Racial Slurs spoken against the entire Indian-American community in the history of United States of America by a white radical group sponsored by Mayor Choi’s administration and Police department under the banner of PBA in broad day light in the very presence of Print & TV media on the same day.

We still appreciate and acknowledge your honesty and courage in taking moral responsibility for the serious lapses on the part of Edison Police for not installing video surveillance cameras in all petrol cars and for not sending its officers for sensitivity training as promised by you in Aug. 2005. We are at extreme pain to point out that you have tarnished your own character, fabricated trumped up charges against the unarmed victim Rajnikant Parikh of police brutality should have been completely dropped rather than being down graded. You are fully aware about the reasons for these fabricated trumped up charges; Parking Violation Summons being issued by Officer Michael Dotro for legally parked cars at the time of arrest of the victim who does not own a car.

Mayor Choi should have ordered Federal Investigations in this inhuman incident of July 4, 2006 when allegation of illegal Summons to Legally Parked Cars, Racial Bias and Police Brutality were brought to his attention. Especially when the officer involved was Michael Dotro, who has the insanity to trample with his boots two unarmed Indian-American businessmen in Aug. 2005 in full view of our so called coward community leaders loyal to politicians only. Mayor Choi instead went along for a sham investigation by Internal Affair department of his Police department who had cleared this same officer for brutality in 2005 also. Edison Police has a checkered history of uncivilized, unlawful, inhuman behavior by some officers. Mayor Choi under pressure from them and their unethical union a circus called PBA with massive financial resources and aprx. 190,000 headstrong memberships acted like a pawn in their hands. As a politician he could not ignore PBA which may be over 300,000 voters when you account for the family members of these PBA members. Still this Circus is calling for Joker Choi’s resignation!

In a very short time Mayor Choi has reformed himself to adopt the corrupt and racist machinery of Edison and has been dividing the Indian-American community ever since he has taken office. He promised carrots to few rootless unethical individuals in the community with their personal agendas and their craze to be seen in the company of politicians in front of Media to settle the case of Aug. 2005 Police Brutality against two Indian-American businessmen involving the same officer Michael Dotro. Now Mayor Choi is again playing the same dirty game of carrots, divide, rule and secretly meeting the same kind of individuals at Rainbow Distributors and recently met Satish Poondi, Jassal Amin and Bish Majumdar at Satbari Restaurant owned by one Albert Jassani who could hardly spell the word “Politics” but his craze to pose with Politicians is remarkable. He is a big financier to the local, county and state Democrats of New Jersey. Satish Poondi was extended the courtesy by Mr. Kothari to attend both meetings with you and others including Mayor Choi held on Aug. 23rd & Aug. 29, 2006. Somehow for the reasons best known to him he never showed up on both occasions. Mayor Choi is an elected official and he must make public full contents of these secret meetings to avoid further damage to his own credibility and ability to govern 4th largest town Edison in the state of NJ.

In disrespect to his senior Democrat Leaders and you, Mayor Choi also broke the protocol of Aug. 23, 2006 “no comments to the Media till our second meeting” by arranging a stage managed Circus on Aug. 25, 2006 in the Hill Top Complex by misusing the official machinery with the help of his Secretary Priya Gopalan, her husband Ravi Gopalan with aspirations for official contracts in return for fund raisers for recently concluded Mayoral Elections for Mayor Choi, Nilesh Disondi with aspirations for Council Seat and Dr. Prasad as per rumors aspirations for some land deals. This trio were acting as hacklers and were publicly intimidating individuals who were asking legitimate questions to Choi. None of these above named individuals feel that honor and dignity of the Indian-American community has been compromised with worst ever Racial Slurs under the administration of Mayor Choi and Edison Police under the directives of PBA. None of these individuals feel that the honor and dignity of the Indian-Americans is far greater than their greed for some petty personal material and financial gains.

Recently “Desi NJ” life style magazine rewarded State Rate Payer Attorney Democrat Seema Singh for not taking any stand by putting her coward & greedy face on the cover and also giving high praise to Upendra Chivukula for his cowardly acts in this master piece of yellow journalism.

Please be advised on behalf of the victim and his wife we demand complete withdrawal of all fabricated and trumped up charges against the victim Rajnikant Parikh. When Mr. Parikh has done nothing illegal or wrong on July 4, 2006, why he should accept any kind of fabricated trumped up charges against him? This is against the doctrine of Equal Justice. Rather Officer Michael Dotro should be disciplined and legal action must be taken against him under Bias Crimes to set an example for those in the uniform like Chisholm, Kahora etc. of Springfield who does not believe in secularism. Our original demand for independent investigations in to the incident of police brutality of July 4, 2006 and Aug. 2, 2006 illegal role of Edison Police which led to the arrest of the victim by ICE, by Attorney General’s office or US Attorney’s office must be complied with without any further delays. In 2005 Jun Choi promised reforms and secular administration to the minority voters especially Indian-Americans who constitute 30% of the population to get elected Mayor of Edison the 4th largest Municipality of New Jersey. True to his words he has certainly reformed himself in a very short time and has joined the Bandwagon of morally and ethically corrupt politicians of NJ. Rather than bringing any real reforms and secularism in the legally corrupt and racist administration especially police department of Edison he has accepted role of the Clown of Edison Circus under the Ring Master PBA a monster with 180,000-190,000 strong heads a big block of voters with expensive lobbyist in Trenton and finances to Election Campaigns of the Law Makers of New Jersey. Even in the most corrupt democracy’s you can not find Unionized racists posing as Law Enforcement Officers because a Police Union is considered highly unethical & immoral.

On Aug. 23, 2006 in the presence of Senator Barbara Buono, Assemblyman Peter Barnes, Mayor Choi, Police Chief Mieczkowski, Deputy Chief Gerba and Middlesex County Prosecutor Bruce Kaplan questions were raised on the credibility of Internal Affairs Department where a citizen has to file complaint to the person against whom he has the complaint. Then the issues were raised what incentive Law Makers has, to go against unethically Unionized Police Department alias PBA a big chunk of voters as well as financier to their own Elections to the Public office. This is a legally corrupt rotten system where a helpless poor resident with no resources has to prove he is not guilty in front of a system which is well oiled, overstaffed with Tax Payers Money where every one is a friend of every one against their common enemy “The Tax Payer itself.” Prosecutor Kaplan took very strong objections to these remarks by Dave Makkar and shot back you mean to say that we are all conspirators?

Then the questions were raised By Mr. Kothari about the process of clearing the officer Dotro based on the basis of 911 calls, his own statement and statement of his colleagues without any credible evidences like video recordings and refusal of the internal affair that they don’t need the statements of the resident witnesses because every one is going to say the same thing. Mr. Kothari pointed out the 911 calls were made between 8.00 P.M. to 9.00 PM. Where as the arrest took place around 11.00 P.M. when there was no fireworks going on. In reality the incident was Dotro under racial bias was writing Parking Violation Summons to the Legally Parked Cars to which some residents made strong objections and had heated exchange of words with him. Further Mr. Kothari took strong objections to all the fabricated false criminal charges against Raj Parikh and a statement attributed to him by Dotro that “In India we do not respect Police,” Raj assaulted him and according to Dotro 700-800 residents present at that time as utter non-sense nothing but racial bias towards a law abiding peaceful community.

Dave Makkar raised the issue of worst ever Racial Slurs in the history of United States of America made against the entire community of Indian origin in New Jersey on Aug. 2, 2006 by a White Radical counter demonstrators sponsored by PBA and Choi’s administration which may have surrogates of officers of Edison Police Department. Police Chief who thinks we lack intelligence made a silly remark, “I don’t know any of those counter demonstrators and I don’t know from where they came.” Dave made a demand for unconditional written apology from Mayor, Edison Police and PBA for these inhuman, uncivilized Racial Slurs against the community of Indian origin. Chief Mieczkowski added he can not do it. If he does that it means we have done it and PBA will be after my neck. He is more worried about PBA and does not care about the sentiments, honor and dignity of the Community which has been compromised. Mayor Choi said he has condemned them into his press statements. Dave’s response was if you have condemn them then on moral grounds you should not have any problems for a written apology because it is your administration under which this shameful inhuman incident has happened and you are not above Republican Senator Allen of Virginia.

On the issue of who called ICE Mayor Choi and Chief Mieczkowski again underestimating our intelligence said that they had no prior knowledge that ICE is coming to arrest Raj Parikh under selective enforcement of Law and in violation of his civil rights; “Freedom of free Speech” from the venue of his protest against Racial Biased police brutality. If they rally had no knowledge that makes them pawns in the hands of monster PBA who has complete control of the Edison Circus (Administration) Co.

Mr. Kothari and Dave Makkar retreated their demand for independent investigation by Attorney General’s office or U.S. Attorney’s office in the July 4th, 2006 Raj Parikh’s racially biased arrest and his brutal beatings by Michael Dotro, Aug. 2, 2006 Racial Slurs against the community by White Radicals sponsored by Administration, Police department & PBA and subsequent arrest of Raj Parikh on that day by ICE.

The meeting lasted more than 3 hours inconclusively, we are sincerely thankful to Assemblyman Barnes and Senator Buono who were gracious enough to take the blows from both sides in the mediation process. Our special thanks go to Prosecutor Kaplan who honestly admitted the serious mistakes of Edison Police Department for not installing the Videos in Patrol Cars and not sending their officers for Sensitivity Training as promised by him in Aug.- Sep. 2005 in the matters of brutal beatings by Michael Dotro of two respectable Indian-American businessmen Bimal Joshi and Atul Patel. It was agreed that both sides will meet again and in fact there is a meeting tomorrow at 10.00 A.M. in the prosecutor’s office in which no politician is taking part.

Since 8-23-06 Mayor Choi is busy in poorly drafted comedy shows like meeting the Hill Top Residents on 8-25-06 arranged by 3 traitors Nilesh Disondi, Dr. Prasad and Ravi Gopalan with vested interests to get some business from the township and Gopalan’s wife Ms. Priya is already a paid secretary of Mayor Choi. In that meeting Dave Makkar asked him the same questions which were asked by him and Mr. Kothari on 8-23-06. Mayor Choi practically dodged all of them and publicly misrepresented on some of the issues. The same is true for the Assemblyman Upendra Chivukula, State Attorney Seema Singh, DOT Commissioner Kris Kolluri and Planning Board Chairman & defecto owner of Dashmesh Durbar Hardyal Singh Johal licking the feet of Democrat Party bosses of NJ is more important.

Even the so called US Indian Political Action Committee USINPAC under the kitchen cabinet of Democrat Sanjay Puri & Jay Choudhary has failed to protest or make any kind of remarks for the incident of Aug. 2, 2006. They were very quick last month in demanding the apology from Republican Senator George Allen of Virginia for calling a Democrat Activist Sidharth a Monkey in his campaign speech. As far as NJ Republican Party is concerned the incident of Aug. 2, 2006 is a case of “Domestic Violence” between 2 Democrat factions because of their perception that Indian-Americans of NJ do not vote for them. But when it comes to Jews who controls NJ’s economy & politics and do not vote for Republicans, they will trash every one who makes even a passing remark against Jews. All of this is a case of moral and ethical corruption and shame on every body.

To put salt to the injuries our spineless, morally & ethically corrupt leaders honored the Democrat Mayor Jun Choi and other bosses from Democrat Party on (India day) Democrat Parade on 8-13-6. Jun Choi was honored against over 400 signed petitions from the community not to even invite him for the Parade. Rest whatever happened in the Parade is known to the entire world. Bipasa Basu Paid Grand Marshal for the Parade was publicly mistreated and her Right to Protest against her mistreatment was violated in the presence of Elected and Appointed Officials of NJ as well as US Senator Bob Menendez in broad day light in front of Print & TV Media. These leaders illegally gave $20,000 in cash to Ms. Basu which amounts to Money Laundering by a non-profit organization.

Indian & US media reported mental, physical & emotional sufferings of Bipasa Basu but no one care about worst ever racial slurs spoken against the entire community of Indian origin as well as the sufferings of US born Julie Patel since July 4, 2006 because of the Police Brutality and Selective Enforcement of Law against her husband Raj Parikh. We appeal to every individual of Indian origin to defend your honor and ask for written apology from Mayor Choi, Edison Police, PBA & all the Democrat present on India Day Parade including their Party Chairman Howard Dean. It is a shame to see the so called community leaders from tri-state area who are least bothered about the human dignity and self-respect and hold their Democrat Party affiliation above their own community. They openly indulged in cowardly acts done without application of mind like honoring a Democrat Mayor against the wishes of the community in a public ceremony whose racist administration is responsible for calling the entire community of Indian origin cockroaches, animals, illiterates go home etc. on Aug. 2, 2006. The NJ Republicans should also be ashamed for not reacting to the sufferings of Indian-Americans because of general perceptions they don’t vote for them?

This week the Democrat controlled USINPAC was very quick in demanding an apology from a Republican Senator George Allen from Virginia for calling S. R. Sidharth a 20 year old Democrat Party activist a monkey during one of his campaign speech. It is certainly a very bad remark Senator has made in bad taste by being disrespectful to the creation of Almighty God. Senator must tender an apology to Mr. Sidarth for his prejudiced, uncivilized, unwarranted and uncalled for remarks. But they have yet to react to the most derogatory, abusive, highly insulting Racial Slurs ever made for the entire community of Indian origin on Aug. 2, 2006 by Democrat controlled racist administration & Police Union sponsored group of white radicals and the arrest of a community member under Selective Enforcement of Law just because he questioned the police brutality of July 4, 2006 against him under prejudice to his racial background.

These so called leaders especially from New Jersey are scared of racist Police & politicians from Democrat Party. In broad day light in front of the media as well as their own community including children & women, they can lick their shoe soles. Further on 8-13-06 they physically stop a woman Bipasa Basu a famous actress from India who was the Grand Marshal for India Day Parade in the presence of a Democrat Mayor, Assemblywoman & Senator from speaking out against the surrogates of some of these leaders who tried to molest her on way from NY. They have made multiple threats to another woman US born Julie Patel & her friends with arrests and social black mailing if they hold a protest rally to ask for equal justice, equal respect in the matters of Racial Slurs to the entire community and civil rights violations to her husband Raj Parikh.

Edison Police needs no introduction for its checkered history; an officer fled the scene of an accident last summer completely naked, an officer admitted waving his gun during an off-duty argument, an officer paraded naked in front of a hotel room window during a convention, six years ago an officer was convicted of robbing a Bank an hour before he reported for duty, another was convicted of raping a drunken woman in her home in 1995, an officer Michael Dorto in Aug. 2005 brutalized two Indian-American Businessmen in front of our so called community Leaders and the same Dorto brutalized Rajnikant Parikh for illegal fire works done by others on July 4, 2006 and when Raj was demanding justice got him arrested by ICE knowingly under Selective Enforcement of Law by misusing the local, state, federal machinery in gross violation to his civil rights.

Their counterparts in Springfield township are no less racist can ignore multiple documented complaints of; illegal fire works done right next to the property of an Indian-American, threatening e-mails, letters, phone calls, damage to his property, violation of his Civil Rights, an officer stop his 5 yr old & 9 yr old at gun point from entering the Court Room during recess from meeting their mother when the racist white group was eating & drinking inside to celebrate their racist joy after intimidating and threatening a Indian-American woman under a prejudiced racist judge. This judge knowingly allowed false witnesses, evidences, wrong translator and imaginary obstructions to intimidate harass and discredit her. Indian-American husband of this woman for raising the issue of racism, professional and ethical corruption by the Springfield administration was interrogated for being a “Terrorist”. Twice he went on a Day’s hunger strike along with his family outside the Municipal Building to demand Equal Justice & Equal Rights. On both occasions no one from the racist administration of Springfield and non-active insane Governor Cody’s administration ever approached the family to ask why they are sitting outside the Municipal Building despite having prior knowledge of the hunger strike.

Because of our coward leaders so many incidents of bias crimes against Indian-Americans go unreported. Even the one those are reported these leaders have never taken a public stand. Our Sikh families being the target of bias crimes for being from Indian origin are further targeted for mistaken identity with terrorist organizations and their children; boys for long hairs and turbans are targeted for their religious believes.

Whatever is happening to Indian-Americans in legally corrupt & legally racially segregated New Jersey is really shameful. For long the Free World has considered the U.S. as the role model for Freedom and Democracy. Is this changing now? We hope the Citizens of New Jersey and even that of the entire United States raise their voice in defense of the values which are so magnificently enshrined in the U.S. Constitution. These values must be defended and upheld whenever they are challenged at all cost.

SILENT PROTEST MARCH AGAINST RACIAL SLURS

Number of intellectuals, philanthropists, defenders of freedom and civil right activists with greater eloquence and more original minds than we posses has spoken on these issues of Racial Equality and Equal Justice for All. Unfortunately NJ is the worst example of racial segregation, moral and ethical corruption. Yet no one mention the word Race in this state. It is not the question of Mayor Jun Choi of Edison or Clara Harelik of Springfield presiding over racist administrations. It is also not the question of Police Officer Michael Dotro of Edison practicing brutality on unarmed colored residents Raj Parikh, Bimal Joshi & Atul Patel or Officer Kahora pulling a gun on a 5 yr old & a 9 yr old colored children. It is not the question of one Rajnikant brutally beaten by the police in Edison. It is the question of complete failure of our Secular System and we must try to make it secular. In order for us to do that first of all we must believe in Rev. M.L.K’s divine vision “First and foremost we are American Citizens. We are not here to advocating violence. The only weapon we have is the weapon of protest. The great glory of American Democracy is the right to protest for your rights.”

That’s exactly what we are doing here to day protesting against the gross injustice, racial discrimination and human rights violation done to so many Rajnikants by the NJ police in different parts of NJ. There are so many Rajnikants who have suffered in other parts of NJ. As Rev. King said “Injustice any where is a threat to justice every where.” The incident of police brutality and local government & police sponsored Racial Slurs against a minority community in Edison on July 4, 2006 and Aug. 2, 2006 is a threat to all minorities living in other parts of NJ. This protest symbolizes the protest and silent sufferings of so many other Rajnikant’s in different part of NJ. We demand Suspension of Officer Michael Dotro along with officers involved in selective enforcement of immigration laws and prosecution of individuals involved in inhuman Racial Slurs against the entire community of Indian origin to send a clear message to all those who are occupying the seats of power in NJ that they must believe in Equal Justice & Secular values of America. Dear Sir:

As you are aware our Indian Business Association, Inc. already has the permission for the “India Day Parade” for Aug. 13, 2006 starting from Edison and finishing in business district of Iselin.

Due to the very unfortunate events of July 4th, 2006 of police brutality against unarmed civilian Rajnikant Parikh by Edison Police Officer and Aug. 2, 2006 in which a group of radicals backed by Mayor of Edison Jun Choi, his police department other officials and PBA called the entire community of Indian origin cockroaches, animals, illiterates etc. and other racial slurs we will be holding a Silent Protest Rally on Aug. 13, 2006. This is an example of our morally & ethically corrupt system of 566 legally racially segregated towns and corrupt over sized administrations in which the employee unions including Police unions openly finance the elections of the corrupt politicians. For that reason they have no reason or any incentive to go against each other or take any or even a disciplinary action. So any complaints against these unionized politicians & employees never brings any justice to the victims especially if they are colored and are from Indian origin who strongly believes in non-violence and rarely have shown courage to speak against injustice done to them even in broad day light. It is not the question of Mayor Jun Choi or Clara Harelik or Sy Mullman or police officer Michael Dorto or William Chisholm or Kahora it is the question of gross violation of human rights on the basis of race, gross injustice & mockery of Democracy all over New Jersey.

The person Raj Parikh who showed the courage to demand Equality and Justice was arrested by the INS the moment he reached the Municipal building compound of Edison on immigration violations. He or group of his supporters offered no resistance and made no comments even on this gross misuse of local, state and federal machinery by the Edison Police and Mayor Jun Choi’s administration to apprehend a person who can not be termed totally illegal when as per the admission of Congress there are 14.2 million illegal aliens in USA. Mr. Parikh had a Deportation Orders issued by an El Paso Judge in his absentia in 1996. Whereas the facts are he left USA on April 15, 1996. He reentered USA on H 1 B visa in Dec. 16, 1999 got married to born US citizen Julie Patel Nov. 5, 2003 and got temporary status an A number from INS after an interview of the couple on April 21, 2005. He did file a Motion to dismiss the 1996 orders of El Paso Judge in 2005 which was denied in June 2005. We are totally against any amnesty to illegal aliens but whatever the Congress will decide for 14.2 million illegal aliens the same should have been applied to Raj Parikh also. Here is a classic example of Selective Enforcement of Law by the administration and police department of Edison misusing Tax Payers money to silence a person who is questioning police brutality and our morally, ethically corrupt and rotten system of 587 legally corrupt and racist governments.

To protest against the gross injustice, selective enforcement of law, police brutality and name calling the entire community from Indian origin with racial bias and prejudice and the rotten system of 587 legally corrupt and non-secular governments we will be holding a SILENT PROTEST RALLY. This will start from Iselin the moment India Day Parade finishes with Pledge of Allegiance to the American Flag followed by National Anthem and a prayer to God. The rally will finish at Edison (starting point of IDP) with Pledge of Allegiance to American Flag followed by National Anthem and prayer to God.

Please be advised no one marching in this Rally is allowed to make any slogans or comments or speech even if he/she is provoked by any radical/racist individual including radical groups backed by Edison or Woodbridge or State Police or PBA or the racist and corrupt administration of Mayor Jun Choi of Edison. Please make sure not to aggravate and hurt the sentiments of the community from Indian origin; keep the traitor to our community Assemblyman Upendra Chivukula who wants to stay in politics by licking the shoe soles of racist Political Bosses of his party and morally corrupt Mayor Jun Choi away from the Silent Protest March as well as India Day Parade. Please be advised we are in possession of more than 500 signatures of Edison Residents who does not wish Mayor Choi to be present for India Day Parade on Aug. 13, 2006 on Oak Tree Rd.

I am very disappointed with your response of 7-27-06. Please be advised once again I would like to make it very clear I am not asking for Honorable President’s help in any of our personal matters. Moreover whatever my correspondence contains on the above referred matters it is not an editorial or work of fiction or my mere frustration. Every data can be verified with the state Governor Corzine who bought this post for $80 Million dollars or from the quasi criminal attorney general of this state appointed by him.

Your contention on behalf of the President “we appreciate your views and welcome your suggestions” so please be advised the suggestions are already incorporated in my earlier correspondences sent to the Honorable President on different occasions. For your convenience I am summarizing them again:

1. Regionalize 587 legally corrupt and racist local governments with 566 Mayors, 3,000 Council Members aided by 3,000 attorneys into 15-18 Local Governments with that many District Planning/Zoning Boards under one Centralized Board.

2. Regionalize 611 Racially Segregated School Districts with 651 School Superintendents, 5,000 Elected School Board Members and battalions of non teaching staff into 15-18 School Districts with that many Assistant School Superintendents and 1 Superintendent with non-elected local parents as School Board Members for every School with tenure of 1 year in each district.

3. Regionalize local Police with 500 Police Directors, 580 Police Chiefs, 580 Dy. Police Chiefs and a battalions of Unionized Legal Criminals posing as Law Enforcement Officers who can cancel summons issued to a person with tainted professional/financial history for driving a vehicle with expired registration and suspended license on the intervention of state attorney general; then allow this State boyfriend to drive that vehicle to be escorted by a state trooper and the Attorney General herself, can pull a gun on a 5 year & 9 year old child from minority in Springfield township, can report a law abiding minority US citizen to State Police that he is a terrorist because he raised his voice against the gun pulling officer and his racist Chief, can run stark naked on the streets of Edison, can beat an unarmed civilian from a minority after hand cuffing him in front of his wife in Edison. If the community demands justice these knuckle head unionized legal criminals under the banner of PBA posing as counter demonstrators can call the entire Indian Community cockroaches, animals, all kinds of racial slurs and want them to go back every thing in front of the so called Free & Fair Media controlled by people with vested interests and the so called Political Gangsters of Edison posing as Elected Officials. To control these peaceful, non-violent senior citizens, women, children and highly qualified professionals & business owner demonstrators chanting “We want Justice, God Bless America” from minority Indian Community “All White Police Force & PBA Counter Demonstrators” were deployed in the ration of 1:4. The Edison administration by using the Rocket Science “The Local, State, Federal Government Machinery and Tax Payers Money” got the victim arrested by INS officials on the 10 year old pending deportation orders of 1996 from El Paso, Texas. Victim is married to an American Citizen since 2003 and did appear in front of the INS officials in April 2005 who gave him an A number by adjusting his status temporarily. Don’t you think he should have been arrested then and right there? I am dead against amnesty to any illegal alien but I want a workable solution fair and just to every one for this complex problem. According to the admission made by US Senate & Congress there are more than 14 Million illegal aliens. Don’t you think the above incident is “Selective Enforcement of Law” to silence a legitimate demand for justice against Police Brutality and Human Rights Violation? Then a Senate Member from NJ Robert Menandez was instrumental in installing Zulima Farber a quasi criminal as Attorney General of NJ so far who has proved to be disgrace only just to play the race card “Hispanic Votes” for his bid to get legitimacy as Elected Senator, for the post which he inherited from a multi billionaire Jon Corzine who bought it for $63 millions. This Robert Menendez I refuse to call him a Senator because no one voted for him for this position, has never spoken against organized illegal immigration by Hispanics. You think “Hispanic Race Card” is not a violation of Election Ethics? Yes I want this Unionized Oversized Battalions of legal Criminals created by local political gangs with best criminal minds (attorneys) to be reduced to 20-25 Districts with 1 Police Director, 1 Police Chief and 20-25 Dy. Police Chiefs with adequate number of Patrol Officer from all communities to make the streets of New Jersey a safe experience for every one in dealing with a secular law enforcement agency.

4. Regionalize Municipal Courts the ultimate Dens of Corruption with 537 Municipal Judges where a Steven Firsichbaum by being racially prejudiced against a woman from minority can say 8 feet is bigger than 21 feet to favor a member from his community and a insane, racist Ron Venturi can call a law abiding respectable minority US citizen, “Don’t touch this book, it is not your religious book. Just raise your hand.” After the proceedings can tell him “Get out of Here.” These should be regionalize into 40-50 districts with 200-250 judges.

5. Bring Pension & Medical Benefit reforms for the state and local unionized too many workers at par with Private Sector or other reformed states of America. We must reduce the number of employees also.

6. Reduce the number of Assistant Attorney Generals from 574 to 250. More stringent Code of Ethics for judges and attorneys.

7. Enforce the principal of one man one post rule as in Indiana. Let it be a punishable offence punishable up to 3 years for any one holding more than 1 elected office or holding state or city job along with an Elected Office. Any one running for Elected Office must resign his State/City Job before filing nomination

8. Bring Election Reforms; all Elections should be state funded or there should be a maximum limit on spending to stop billionaire like Jon Corzine to make mockery of our Democracy like spend $63 million to become a Senator and if you don’t like it spend another $80 million to coronate a carrier politician Robert Menandez with tainted past to finish your unexpired term. There must be an overall spending limit which must include any money spent by any PAC or any Organization or any Labor Union or any Individual endorsing that particular candidate.

I was representing myself on my own. Honorable Judge upheld my rights to my defense and he further stated that I am entitled to the information requested from the Springfield Police.

Hon. Judge: To the Prosecutor Thelander why I was not provided with the

Prosecutor: He asked for carte blanche things and that was turned by you. Well
the only one I got here was the one that was on Sep. 12th which is what, 3 days ago and here we are at trial. (he had replied to 8-30-05 request)

Judge: I am talking about the letter he wrote to the chief of police on Aug. 30th
requesting information from the police department. And what the court had
denied is a number of Subpoenas. Clearly from the tenor of the defendant’s
letters back and forth, it appears that he believes that there was selective
enforcement. Am I correct Sir (To Makkar)?

Makkar: Yes, Sir.

Judge: Since the defendant has raised the issue of selective enforcement and since I think it is important that he have the information available to him, that
since it wasn’t provided and I have no reasonable explanation as to why it wasn’t provided, the court is strongly considering to dismiss the summons. The court did not deny his right to receive certain information to prepare his defense of the ticket. As a result court is dismissing the Complaint.

Please be advised that I have filed complaints against the presiding judge Hon. Firsichbaum of this Court with the various state departments for the following reasons:

In the matters of Madan v. Sobel & Sobel v. Madan, SPR 022226 etc. (date of judgment Nov. 29, 2004), the judge has presided over a trial by being biased, partisan, intimidating, unfair, abusive, prejudiced and racially discriminatory to our entire family. Knowingly he has allowed counsel Keith Biebelberg’s false independent observers, false witnesses, false evidences including imaginary view obstruction in his court in these matters. Then he ignored Police Officer Kahora’s Police Brutality against my 2 minor children and myself on the instructions of counsel Keith. On the advise of his friend counsel Keith he imposed a wrong and unqualified translator on my wife Mrs. Rashmi Madan Makkar for a language which both of them do not understand, speak and write. Also again on the fraudulent advise of the corrupt and communal counsel Keith he dismissed our expert’s Accident Reconstruction Report along with the fraudulent/fabricated report of the counsel Keith’s expert. On 3 separate occasions he unlawfully/illegally dismissed Motion for his own Recusal to favor his friend counsel Keith. To make the matters worst the judge himself lied and misrepresented so many times in the open court to favor his friend counsel Keith. Unlawful/illegal/discriminatory/partisan actions of the judge in these matters are contrary to the moral/ethical/professional code of conduct for a judge. That the judges are above law; are not supposed to take sides and they have to respect the doctrine of “Equal Justice to All”. The unlawful/illegal/immoral and unethical/discriminatory actions of Hon. Judge Firsichbaum do not give me any confidence and faith in the Hon. Judge Firsichbaum and the Springfield Municipal Court as well as the Springfield Police under the command of a morally/ethically and professionally corrupt/communal Police Chief William Chisholm.

Moreover the above summons # K-047616 represents bias, prejudice, intimidation, coercion, partisanship, racial discrimination and profiling on the part of Police Chief Chisholm and the officer Dauser I.D. # 604. There are no such signs of No Parking between 2.00 A.M. and 6.00 A.M. on Ashwood Rd. Then there are my other neighbors who always park on the Ashwood and I have proof of that. On top of that I have been living here since 2001 and on number of occasions I have parked outside no such summons were issued then. All of a sudden why I have been singled out that too for an ordinance which is applicable to major roads coming to the town not to a road, which is purely a residential road with a dead end on west side? Why select people who are close to the judge, police chief, mayor and council members are given illegal favors even to make undisclosed amount of money at the risk of human lives and their properties on Ashwood Road?

The same police chief along with the Mayor have allowed an individual to convert his property as link road between Ashwood and Baltursal Golf Club to benefit this individual for an undisclosed amount of money known as PGA truck Gate 3. This has been done without the consent of the residents of Ashwood Rd. and a Variance from the Board of Adjustment of the town. Ashwood Rd. has been converted into a commercial highway with commercial traffic practically all day and at odd hours of the night and very early morning putting human lives and their properties to all kinds of danger including environmental pollution and disturbance during sleeping hours. No safety measures like speed breakers or extra signs “Watch for Children at Play” has been installed by the Police Department to stop the 18 wheelers with trailers, big trucks and other vehicles to stop them doing 30-40 MPH on purely a residential road with a dead end on west side with legal speed limit of 25 MPH.

Since July 4th, 2005 our entire family is the victims of hate crimes and racial discrimination. See Police reports # 2005-32631, 3937, 4034, 4254, 4713, 4780, 4837, 4934 and the summons in question K-047616. (See enclosed Hate Crimes/discrimination)
We suspect Hon. Judge Firsichbaum, Police Chief Chisholm, Mayor Mullman, Ex-Mayor Harelik, Counsel Keith Biebelberg and our neighbor Steven Sobel are behind these crimes against us, for reporting against them to the various depts. for their unlawful, illegal, corrupt and communal actions in the matters of Madan v. Sobel and Sobel v. Madan and corruption in PGA and Fire House Deals.

Then on Aug. 8th, 2005 when I was protesting outside the Municipal Building to demand Resignation of Hon. Judge Firsichbaum and Police Chief Chisholm on account of unlawful/illegal/communal moral, ethical and professional issues. The judge/his office called the state police citing concern for his security. Sgt. David Chamber who met me that day was very skeptical about this call. He further added, “I am a hard working, law abiding, a strong believer of non-violence decent man. He is doing his duty because the Judge’s security comes under his department. Again said that chief and judge are not going to resign on my demands and I should not hurt myself by going on hunger strikes.

I told him if they do not want to resign let the police chief take proper disciplinary actions against the guilty Police Officers and the judge should transfer the case Madan v. Sobel etc. to be reopened by a different judge and recommend to the proper authorities to revoke the license of Mr. Keith Biebelberg to Practice Law in the State of New Jersey.

I am highly concerned and very much worried about the safety, security and lives of my family and myself from all these above named individuals who are very powerful/corrupt/communal and will not hesitate to do harmful things to my family and myself. Ex-Mayor Clara Harelik last year threatened me over the phone, “You have annoyed lot of people in the town. You may not like the end results”.

Certainly the end results are not to our likings according to her but the final end results have yet to come which may not be to the likings of all of the above named individuals. There can be delay in the justice in the House of God but we will certainly get the justice. Fortunately the taxpayers/residents of Springfield will definitely like that justice. There is an authority above them in the state and federal government along with the God who can boot them out of the power/positions and some of them may be prosecuted on criminal charges including perjuries/corruption

Under the above circumstances and risk to my life, security and well being physically/mentally I refuse to be present in the court of Hon. Judge Firsichbaum and the Municipal Court of Springfield. The judge along with the above named individuals jointly/separately openly/under cover along with his knowledge of law and power can inflict physical and mental injuries on me. I am already suffering from the pain and agony he has inflicted along with the above named individuals on my entire family and me. I refuse to take it any more for the sake of my own and my family’s safety, security and physical as well as mental/emotional well being. With this letter I make an appeal to the Hon. Peter Harvey the Attorney General of NJ to provide my family and myself proper security. This should also be treated as criminal complaints against the above named individuals who we suspect are behind the hate crimes and racial discrimination against my entire family and myself.

So kindly transfer the above matters to some other Court and some other judge in the state of New Jersey. Thank you for your attention to this matter.

Respectfully I would like to submit that I am the Manager of a Check Cashing Store in Irvington. I am the only male member in this store. Thursdays and Fridays are our very busy days and we close at 8.00 P.M. After that I do need 30-40 minutes to reconcile cash. On both these days we do carry substantial amount of cash on premises.

The trial date Sep. 29, 2005 is a Thursday that can create security risk for the business as well as for the female staff working at the store. If it is at all possible for the Honorable Court to grant me a new date for any other day of the week except Thursday and Friday, I will be highly obliged.

Please note the new trial date for the above-referred matters is Sep. 15th, 2005 at 9.30 P.M. at Municipal Court of New Providence. Further a request for the following documents was made to the Court Administrator on Aug. 29th, 2005, who has advised me to take up this issue directly with your department. Please be advised I need the following documents well ahead of the trial date of Sep. 15th, 2005 to prepare my defense as well as to prove that you/your department is indulging in racial discrimination and profiling.

It was your department who filed a false/fabricated/fictitious report on July 15, 2005 with the State Police that I was video filming the DMV facility in Springfield with some kind of anti national motives. Sgt. David Chambers from the State Police interrogated me on July 18, 2005 in the presence of Sgt. McNanny of Springfield in the chambers of the Municipal Building.

Please note in addition to the documents/information already requested on Aug. 30, 2005 I need the following information/documents. Please be advised I need the following documents well ahead of the trial date of Sep. 15th, 2005 to prepare my defense as well as to prove that you/your department is indulging in racial discrimination and profiling as well as keeping their eyes closed to the hate crimes against me and my entire family since May 21, 2004 by some individuals/residents known to Elected/Non-Elected Officials of this town. All these individuals are a disgrace to the beautiful community of the town, whom we honor, admire and respect for their customs and values.

1. Copy of the Town Ordinance showing Ashwood Rd. under the 2-6 A.M. No Parking Zone. Why no such sign is posted on Ashwood Rd.? Also a Copy of the Rules or Criteria to declare a particular road as No Parking 2-6 A.M. road.

Copy of the Permission Granted to the owner of PGA Truck Gate 3 to convert Ashwood Rd. into a Commercial Highway for more then 2 months for huge financial gains to the property owner. And may be direct or indirect favors, consultancy fees, and financial gains to some of the Elected/Non-Elected Officials of this town. Also the copy of the Ordinance or Rules under which this permission was granted by endangering the life, security and properties of the residents of Ashwood Rd., Statile Ct. and Sherwood Rd. for this illegal/inhuman permission granted by you/your department and the other elected/non-elected town officials.

Number of Egg Throwing incidents on vehicles parked inside the driveways of properties on Ashwood Rd. and Statile Ct. for the year 2004 and from Jan. 1, 2005 to Aug. 31, 2005.

Number of incidents reported for Properties Vandalized on Ashwood Rd. and Statile Ct. for the year 2004 and from Jan. 1, 2005 to Aug.31, 2005.

Dear Ms. Carra:

Let the Prosecutor Mr. Thelander be advised the information requested # 1, 2 & 3 in my letter of Aug. 29, 2005 has all the relevance to the above racially motivated summons issued to me by the Springfield Police. This information is required to prepare my defense and prove that the Springfield Police under the Chief William Chisholm is biased, prejudiced, unfair, morally/ethically corrupt and racist. I have enough proofs to prove it that the above summons were issued to me by singling out me and is the part of our victimization to Hate Crimes and Racial Discrimination by the Police, Court, Administration and few residents of Springfield. (Details Enclosed)

Since Dec. 2004 I have been requesting the Resignation of Hon. Judge Steven Firsichbaum and Chief William Chisholm on ethical, moral and professional issues in the matters of Madan v. Sobel and Sobel v. Madan, SPR 022226 etc. to various state departments/agencies. Then to demand their Resignations I have twice gone on a hunger strike on July 4th, 2005 and Aug. 8, 2005 outside the Municipal Building of Springfield. Since June 27th, 2005 my entire family and myself are the victims of serial Hate Crimes and racial discrimination under the watchful eyes of the Springfield Police, Administration and Elected Representatives. We suspect Hon. Judge Firsichbaum, Councilwomen Clara Harelik, Police Chief Chisholm, Officers Quirk and Kahora, Attorney Keith Beibelberg, his client Steven Sobel, his false witnesses Mr. Barry Farbstein, Ms. Leslie Kasten, Ms. Lisa Glennon and his false Repair Estimate Maker Dobbs Auto body are behind our victimization. Unfortunately they have the full support of the Administration and the Elected Officials.

Councilwoman Clara Harelik when she was Mayor made a terrorist threat over the phone to me related to then court case. “You have annoyed lot of people in the town, you may not like the end results”. The matter was reported to the Union County Judge and the town attorney at that time, till to date no action has been taken against her.

I would appreciate it if you would arrange for the subpoenaing of Councilwoman Clara Harelik, Officer Quirk and Officer Kahora also for the Sep. 15, 2005 court hearing. This is in addition to the request made for the subpoenaing of Sgt. David Chambers and Sgt. McNanny on Aug. 31, 2005. All of them are relevant in the above matters.

Officer Quirk is responsible for filling a biased and racially discriminatory accident report on 5-21-04 in which my wife and my minor son were hit by my neighbor Mr. Steven Sobel. He totally ignored the visible physical damage to vehicles, weather conditions, distance, and profile of both drivers. Mr. Sobel’s removing all the evidences from the scene of the accident was an indication that he is a liar and a habitual traffic laws violator. Being V. P. of a Corporation he had full knowledge and understanding of what he did that day. Chief Chisholm refused to take a complaint against Officer Quirk or to amend his report and refused to meet us in person, is a proof of his racial bias, prejudice and inhuman approach towards the victims, a woman and her minor son.

Officer Kahora on Sep. 20, 2004 physically stopped me and my 2 minor children (age 5 & 9 then) with her one hand on her gun from entering the Courtroom during the recess to meet their mother. At that time counsel Keith Biebelberg his client Steven Sobel, his false witnesses, his false/planted independent observers were eating and drinking inside the Courtroom. Disgustingly according to my wife one of the so-called female Independent Observer was hand feeding Mr. Steven Sobel. Under this same officer during the hearing of some other matters counsel Keith Beibelberg was keeping his hand on the back of the so called female Independent Observer and his entire group was talking to each other. You allow people to break the decorum of the Court because they are from your community or known to you and then physically stop at Gun Point 2 minor children accompanied by their father from entering the Courtroom during recess is not Racial Discrimination? Chief Chisholm again took no action against his another officer for Police Brutality and Racial Discrimination. Rather Officer Kahora is rewarded and can be seen posted outside the Elementary Schools of Springfield.

Councilwoman Clara Harelik for making terrorist threats to me and shielding Chief William Chisholm and Hon. Judge Steven Firsichbaum who conspired with counsel Keith Beibelberg and his gang to prove that my wife is blind, brain damaged and has no credibility against his habitual traffic law breaker client, false witnesses, false independent observers, false evidence makers, wrong translator and imaginary view obstruction created specifically for my wife by him. On the issue of my minor son’s injuries and his representation by me. Hon. Judge Firsichbaum told me after 4 months, “He is not an injury Court and I can not represent him”.

All these people are responsible for racial discrimination and hate crimes against my entire family and me since May 21, 2004. The above referred Racially Motivated Summons # K- 047616 is a part of those crimes. According to these morally, ethically and professionally corrupt/communal individuals they are the majority in the town, so they are the law. Do you agree with this?

Dear Ms. Carra:

With due respect to Hon. Judge Bogosian, I disagree with him for his denial to subpoena certain people who are very critical to my defense. The above Summons is part of the series of Hate Crimes and Racial Discrimination committed against my entire family and myself since May 21, 2004. With their testimony I will be able to prove beyond any reasonable doubt that Springfield Police Department under the morally, ethically and professionally corrupt/communal Chief Chisholm is very much responsible for the victimization of my entire family and myself since May 21, 2004.

Under his very command my residential road with a dead end on one side was converted into a Commercial Highway. In a MV crash Officer Quirk can ignore visible physical damage in the ratio of 1:8, can ignore Mr. Sobel a well qualified V.P. of a Corp. destroying the critical evidences, can ignore distance, can ignore weather/road conditions, can ignore profile of both drivers and trauma/injury to a minor as well as to a housewife. This officer can file a biased, prejudiced, wrong and discriminatory report to favor Mr. Sobel and gets full support of his Chief Chisholm and then Mayor Harelik for doing that.

His another Officer Kahora can take illegal orders from a unauthorized person counsel Keith during recess; can physically stop with her one hand on her gun 2 minor children age 5 & 9 accompanied by their father from meeting their mother in the Courtroom. It was when the Courtroom was used as an Ethnic Club or Private Dining Room by counsel Keith and his group members with Officer Kahora providing them security. During the proceedings of some other matter Officer Kahora can ignore counsel Keith and his group members using the Courtroom as personal living room. Breaking all the decorum and rules of the Court by talking to each other and sitting inappropriately.

Under his very command his department can file a false/fabricated and defamatory report against me with the State Police. That I was indulging in some kind of anti national activities. Raising doubts about my integrity, my patriotism, my honesty and my loyalty towards my own country United States of America. A person who has been helping the Law Enforcement Agencies by risking his life and money in their fight against financial crimes and identity frauds since 1999. Number of times who has given leads to these Agencies which has materialized in arrest of individuals as well as whole gangs. For that reason I need the testimony of Sgt. David Chambers who interrogated me in the presence of Sgt. McNanny within 72 hours of the complaint by his department.

Councilwoman Clara Harelik, an attorney by profession when she was the Mayor ignored the complaints against the corrupt/racist Police Chief and the Judge. Rather made terrorist threats to me on Aug. 16, 2004 that “I will not like the end results”. These were the end results she was talking; Officer Kahora with her hand on her gun physically stopping me and my 2 minor children, counsel Keith to save Mr. Sobel conspired against my wife with the Hon. Judge Firsichbaum along with his false/invented/tutored witnesses Mr. Barry Farbstein, Ms. Lisa Glennon and Ms. Leslie Kasten along with a false/fabricated repair estimate maker Dobbs Auto Body (all residents of Springfield and belongs to her community) on the biased/wrong/unfair report of Officer Quirk to prove that my wife is blind/brain damaged/not credible in the Court and has hit Mr. Sobel.

Counsel Keith also prevailed in imposing a wrong translator on my wife and creating a non-existent imaginary view obstruction for her in the Court. Unfortunately the judge acted in a biased, partisan, unethical, immoral and non-secular manner during the entire proceedings. (SPR 022226 etc) He openly favor counsel Keith and lied on several issues for his benefit and ruled, “No party can file appeal to his judgment” on Nov. 29, 04

May be on Aug. 16, 2004 Councilwoman Harelik was also referring to illegal Subpoena Summons illegally served to me in my bed, future damage/vandalization to our property & car, fireworks at odd hours to scare our children, threatening/obscene/racist letters/phone calls and again the Racially motivated Summons K-047616 to scare me?

In light of all of the above I have strong objections to Hon. Judge’s ruling on the issue of Subpoenaed Witnesses. The Hon. Judge is denying my rights to my defense and stopping me from exposing the corruption/racism by the Springfield Town Hall.

Once again I make a humble request to the Hon. Judge to reconsider his decision. Let the Hon. Judge accept this letter-brief with the enclosed Hate Crimes and Racial Discrimination against my family and me since May 21, 2004 in chronological order. This may be helpful to the Honorable Judge in its decision to uphold the sanctity and integrity of the Court and the doctrine of, “Equal Justice to all”. His decision will also reflect his stand on corruption/racism in general as well as by the Springfield Town Hall.

So it is my understanding that the sole issue will be my appearance only before the court on Sep. 15, 2005 at 9.30 P.M. tonight. To be clear no testimony will be given by any party or witnesses (expert or lay) regarding any other aspects of this case until the new trial date as decided by the Honorable Judge.

Please be advised under the constitution I have the right to defend myself and prove the above Summons # K-047616 are part of my self and my entire family’s on going victimization since May 21, 2004 for hate crimes and racial discrimination by the Elected/Non-Elected Officials and their few friends/residents of Springfield. The Subpoenaed Officers Quirk, Kahora and Dauser may have acted under the corrupt/communal influence of the Police Chief Chisholm and other Elected/Non-Elected Officials responsible for our ongoing victimization since May 21, 2004. Sgt. David Chambers has interrogated me on false/fabricated/discriminatory/defamatory report of Springfield Police in the presence of Sgt. McNanny. Councilwoman Harelik when she was Mayor made a terrorist threat to me that I will not like the end results.
